Welcome to Tallahassee State College! These Terms and Conditions ("Terms") govern your access to and use of Tallahassee State College's website, online services, campus facilities, and all associated educational, administrative, and recreational programs and activities. By accessing, using, or registering for any of Tallahassee State College's services or programs, you agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with any part of these Terms, you should not access or use our services.
1. Definitions
- "College," "We," "Us," "Our": Refers to Tallahassee State College.
- "User," "You," "Your": Refers to any individual accessing or using the College's website, services, or participating in its programs, including but not limited to prospective students, enrolled students, faculty, staff, alumni, visitors, and applicants.
- "Services": Encompasses all educational programs, academic courses, administrative services, financial aid, campus facilities, digital platforms (e.g., website, learning management system, student portal), and other offerings provided by the College.
- "Content": Includes all text, graphics, images, audio, video, software, data, and other materials available on or through the College's Services.
- "Website": Refers to Tallahassee State College's official website at https://www.tsc.fl.edu.
2. Eligibility and Enrollment
- General Eligibility: To use certain Services, you must meet the College's admission and enrollment requirements.
- Accuracy of Information: You agree to provide accurate, current, and complete information when applying for admission, registering for courses, or using any College service. Misrepresentation or omission of material facts may result in denial of admission, disciplinary action, or dismissal from the College.
- Financial Responsibility: By registering for courses or utilizing College services, you acknowledge and accept responsibility for timely payment of all tuition, fees, charges, and other associated costs assessed to your student account, as outlined in the College's official fee schedule. Failure to pay may result in holds on your account, inability to register for future courses, and referral to collections.
- Compliance with Policies: Enrollment and participation in college programs are subject to your continuous compliance with all College policies, rules, regulations, and codes of conduct, including but not limited to the Student Code of Conduct, Academic Honesty Policy, and IT Acceptable Use Policy.
3. Use of College Services and Facilities
- Acceptable Use: You agree to use the College's Services and facilities for their intended educational and administrative purposes only, and in a lawful manner that does not infringe upon the rights of others or restrict their use and enjoyment of the Services.
- Prohibited Conduct: You agree not to:
- Engage in any activity that is unlawful, fraudulent, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Transmit or upload any viruses, worms, defects, Trojan horses, or other items of a destructive nature.
- Attempt to gain unauthorized access to any portion or feature of the Services, or any other systems or networks connected to the College.
- Interfere with or disrupt the operation of the Services or servers or networks connected to the Services.
- Use any automated system (e.g., "robots," "spiders") to access the Services for any purpose without the College's express written permission.
- Engage in any activity that could damage, disable, overburden, or impair College servers or networks.
- Use the Services for commercial purposes without the College's prior written consent.
- Intellectual Property: All Content on the College's Website and Services, including but not limited to text, graphics, logos, images, software, and trademarks, is the property of Tallahassee State College or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content without prior written consent from the College, except as follows:
- Your computer may temporarily store copies of materials incidental to your accessing and viewing those materials.
- You may print or download one copy of a reasonable number of pages of the Website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
- Faculty, staff, and students are authorized to use College Content strictly for their educational or administrative purposes as part of their association with the College.
- User-Generated Content: If the Services allow you to post or upload content (e.g., forum posts, discussion board entries, project submissions), you grant the College a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate these Terms and will not cause injury to any person or entity. The College has the right, but not the obligation, to monitor, edit, or remove any content.
4. Digital Accounts and Security
- Account Creation: To access certain features of the Services, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.
- Notification of Unauthorized Use: You agree to notify Tallahassee State College immediately of any unauthorized use of your account or any other breach of security.
- Account Termination: The College reserves the right to suspend or terminate your account and access to Services at its sole discretion, without notice, for any violation of these Terms or any College policy, or for any other reason deemed necessary by the College.
5. Electronic Communications and Consent
- Agreement to Receive Communications: By providing your contact information, including your mobile phone number and email address, to Tallahassee State College during the application, enrollment, or employment process, you agree that the College may communicate with you electronically regarding your application status, enrollment, academic progress, financial aid, billing, campus services, important announcements, safety alerts, and other matters directly related to your relationship with the College. These communications may occur via email, text message (SMS), phone calls, and messages through the College's official portals or learning management systems.
- Consent for SMS Messages (Non-Emergency/Non-Transactional):
- For text messages that are not classified as emergency or strictly transactional (e.g., marketing for events, programs, or alumni outreach), you acknowledge that your express consent is required.
- You understand that by opting into such SMS services (e.g., by providing your mobile number and confirming your consent via a specific opt-in method), you are consenting to receive text messages at the provided number, which may be sent using an automatic telephone dialing system.
- You understand that message and data rates may apply depending on your mobile carrier plan.
- Opt-Out: You may revoke your consent for non-essential SMS messages at any time by replying "STOP" to any text message you receive from Tallahassee State College's messaging service. You will receive a final confirmation message upon opting out. You can also Opt-Out of selected communications using https://www.tsc.fl.efu/cp.
- You acknowledge that opting out of non-essential SMS communications may mean you miss out on certain updates or promotional offers.
- Emergency Communications: You acknowledge and agree that Tallahassee State College may send urgent safety alerts and critical operational notifications via text message and email to your provided contact information, even if you have opted out of other non-essential communications, as these are vital for campus safety and security.
- Responsibility for Contact Information: You are responsible for ensuring that your contact information, including your email address and mobile phone number, is current and accurate in the College's records. Failure to update this information may result in missed critical communications.
- Messaging Costs: Standard message and data rates from your wireless carrier may apply. When you opt-in to receive SMS messages, you are responsible for any carrier fees such as data plan charges, text messaging charges, tolls, out-of-area roaming, and other charges. Messaging frequency per month varies based on your student status and associated actions. Check with your mobile operator for details on receiving text messages (SMS).
6. Disclaimer of Warranties
THE COLLEGE'S SERVICES, INCLUDING THE WEBSITE, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE COLLEGE DOES NOT MAKE ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES. WITHOUT LIMITING THE FOREGOING, THE COLLEGE DOES NOT REPRESENT OR WARRANT THAT THE SERVICES, THEIR CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.
TO THE FULLEST EXTENT PROVIDED BY LAW, THE COLLEGE HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
7. Limitation of Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COLLEGE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO THEM, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
8. Indemnification
You agree to defend, indemnify, and hold harmless Tallahassee State College, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User-Generated Content, any use of the College's Content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services.
9. Links to Third-Party Websites
The Services may contain links to third-party websites or resources. These links are provided for your convenience only. Tallahassee State College has no control over the contents of those sites or resources and accepts no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party websites linked to the Services, you do so entirely at your own risk and subject to the terms and conditions of use for such websites.
10. Governing Law and Jurisdiction
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the state or federal courts located in Leon County, Florida, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
11. Waiver and Severability
No waiver by Tallahassee State College of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the College to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
12. Entire Agreement
These Terms and our Privacy Policy constitute the sole and entire agreement between you and Tallahassee State College regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
13. Changes to the Terms and Conditions
Tallahassee State College reserves the right to update or modify these Terms at any time without prior notice. All changes are effective immediately when we post them and apply to all access to and use of the Services thereafter. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. We encourage you to review these Terms periodically for any updates.
